The LamaHero system uses a credit system for payments for services. The advertiser tops up credit in their currency by transferring money to the operator's bank account. No fee is charged for a bank transfer.
Prices quoted in the LamaHero system do not include VAT. The operator will refund unused advertiser credit at any time upon request in internal support. The advertiser's credit is deducted for completed transactions.
The publisher receives credit for completed orders. The operator will pay out credit to the publisher based on an invoice and a request submitted in the user's cash register, most often once every 30 calendar days and at the latest at the end of each calendar year.
The publisher sets the price they will receive for completing an order. No further fees will be deducted from this price. The operator charges a commission for mediating the transaction between the advertiser and the publisher, which is included in the price for the advertiser.
The advertiser uses the LamaHero system to create an order for a promotional article on a selected website.
Orders for services can be placed in the LamaHero system in two ways:
By creating an order, the advertiser commits to payment, and the amount is immediately blocked from their credit.
Order cancellation is only possible by mutual agreement.
It is prohibited to request publication or promote content that violates the laws of the country and good morals, as well as the dissemination of hateful content.
If the advertiser does not approve the service provided within 7 calendar days of delivery by the publisher, the operator reserves the right to approve the order and pay the agreed amount to the publisher.
The publisher prepares or publishes the requested promotional article on their website based on the order.
Website Approval Conditions for LamaHero System
Websites are reviewed individually and the operator reserves the right to reject a website at their discretion, even retroactively.
The publisher sets the price and content conditions in the LamaHero system for publishing an article on the offered website.
After publication and approval of the content by the advertiser or operator, the pre-agreed amount is credited to the publisher as credit.
The paid article must remain available on the website for at least 24 months in its unchanged, approved form. If the publisher has set the article to remain on the website permanently, they are obligated to fulfill this commitment, even in case of contract termination or sale of the website to another entity. If this obligation is breached, the operator is entitled to demand the publisher return the paid price for the article, which will be returned to the advertiser after crediting to the operator's account.
If the publisher fails to deliver the order within the agreed timeframe, the operator reserves the right to cancel the order without compensation. Extension of the deadline is possible by mutual agreement of all parties.
The contract relationship arises when filling out the registration form and confirming agreement with the terms and conditions. User data must be filled in completely and truthfully.
The operator reserves the right to terminate the contract relationship at any time at their sole discretion.
A user of the system can request termination of the contract relationship at any time by sending an email to info@lamahero.com and can thus delete their account. Notice becomes effective on the date of receipt. Rights and obligations that arose before the termination of the contract relationship remain unaffected by the notice.
After giving notice, the user completes incomplete transactions. The advertiser will be sent remaining credit to the account from which the last payment was made. The publisher will be sent earned credit to their bank account based on the invoice.
Unused accounts may be deleted after three years of inactivity.
Keep your account login credentials confidential. We are not responsible for misuse of your account by third parties.
The publisher is fully responsible for article content, or the advertiser if they publish their own article on the publisher's website. LamaHero operator does not assume responsibility for the content of promotional articles, their accuracy, or compliance with the laws of the given state and good morals. The operator also assumes no responsibility for any damage caused to users or third parties.
The operator is not responsible for damage caused by circumstances beyond their control (server outages, power outages, legislative changes, natural disasters, war, terrorist attacks, revolutions, etc.)
All parties to the contract relationship acknowledge that the limitation of liability is a condition of using the LamaHero system and is an essential part of the terms and conditions.
Users must not engage in activities that damage the reputation of the LamaHero system or operator.
Any agreements and transactions between LamaHero system users must take place within this system. It is prohibited to conduct orders and negotiations outside the LamaHero system.
Users must not engage in activities that damage the operation of the LamaHero system through technical means, obtain data in bulk, or extract information from the system.
Websites and demands submitted by users must comply with good morals and the laws of the given country.
Users are required to provide truthful information about themselves and about the websites they offer in the system. The operator is entitled to request data from users to verify the accuracy of the information provided, such as reports from Google Analytics.
Users must not change the content or appearance of approved and paid posts for at least 24 months or according to the specifications of the specific order.
The operator commits not to disclose personal data and user data to any third parties and to protect it using available techniques against unauthorized disclosure.
Users are required to maintain confidentiality of all non-public information of the operator and their system. Non-public information of the operator includes, in particular, information about technologies, source code, conditions and documentation and other documents relating to the operator or the LamaHero system.
Users agree to the collection, storage and processing of their personal data provided during registration, including business name, name and surname, place of residence, telephone and email contact. The purpose of processing personal data is to provide the service to the user and communicate with the user. Users also agree that the operator may use their name and surname (company name) in marketing materials and in lists of customers on its websites. This consent is granted for the duration of cooperation and for a period of 5 years after the cooperation ends.
Users can revoke their consent to the storage and processing of their personal data by requesting deletion of personal data at info@lamahero.com, which can be done after ceasing to use the LamaHero system.
The operator reserves the right to modify these terms and conditions at any time, particularly in the scope of service improvement, clarification of conditions, and provision of new services. The operator will notify users of new terms and conditions at their email address. If users do not agree with the new conditions, they have the right to cancel the services (see Contract Relationship).
If a user or operator does not require performance of any provision of these terms and conditions, it does not mean that they have permanently waived such provision and they have the right to require performance of such provision at any time in the future.
These terms and conditions are valid and effective from January 1, 2024
